WaterBoy Water is operated by Arden Brody Collab, LLC, a Texas limited liability company.

By accessing this Site or requesting services, you agree to these Terms.

This Site is provided for informational purposes and to allow users to submit water delivery inquiries.

You agree not to:

• Submit false, misleading, or incomplete information

• Attempt to interfere with Site security or functionality

Submitting an inquiry does not create a contract or guarantee service.

No Online Transactions

This Site does not process payments or finalize service agreements online.

All services are subject to:

• Direct communication
• Confirmation of availability
• Separate agreement on pricing and scope

We reserve the right to refuse service at our sole discretion.

Service Area

WaterBoy Water provides bulk water delivery services exclusively within the State of Texas.

Service availability may vary due to location, weather, equipment capacity, road conditions, or operational constraints.

Estimates, Pricing & Scheduling

All quotes or estimates:

• Are non-binding
• Are subject to change
• May be adjusted based on site conditions, access limitations, or changes in scope

Scheduling is subject to availability and may be modified due to operational needs or events beyond our control.

Potable and Non-Potable Water Disclaimer

WaterBoy Water may deliver potable (drinkable) or non-potable water depending on customer request and service type.

Customer acknowledges and agrees:

• It is the customer’s responsibility to specify intended use.
• Delivered water must only be used for its designated purpose.
• WaterBoy Water is not responsible for contamination occurring after delivery.
• WaterBoy Water is not liable for improper storage, handling, treatment, or secondary distribution after delivery.

If water is requested for potable use, customer is responsible for ensuring:

• Storage containers are sanitary and appropriate for potable water.
• Distribution systems are safe and compliant with applicable regulations.

Septic System Testing Clarification

WaterBoy Water provides fresh bulk water for septic system testing and related applications. We do not perform septic inspections, certifications, engineering evaluations, or regulatory approvals.

Customer acknowledges:

• WaterBoy Water is not responsible for septic system design, installation, performance, or regulatory compliance.
• We do not guarantee septic test results.
• We are not liable for system failures, soil conditions, drainage issues, or regulatory determinations.

All septic testing outcomes are the responsibility of the property owner and their chosen contractors, engineers, or inspectors.

Customer Site Responsibilities

Customer is solely responsible for:

• Providing accurate delivery information
• Ensuring safe and adequate site access for delivery trucks
• Verifying weight-bearing capacity of driveways, roads, and ground surfaces
• Identifying underground utilities, septic systems, tanks, irrigation lines, and hazards
• Ensuring tanks, pools, or storage systems are structurally sound and properly installed

WaterBoy Water shall not be liable for:

• Property damage caused by unstable ground, soft soil, hidden voids, or improper access
• Damage to driveways, landscaping, irrigation systems, septic systems, or underground utilities
• Delays caused by site inaccessibility

Assumption of Risk

Customer understands that bulk water delivery involves heavy vehicles and equipment.

Customer assumes all risks associated with:

• Vehicle access onto private property
• Ground conditions
• Placement and discharge of water

Delivery onto private property is performed at customer’s direction and risk.

Limitation of Liability

To the fullest extent permitted by Texas law:

WaterBoy Water shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, loss of use, or business interruption
• Property damage beyond the direct area of water discharge
• Delays caused by weather, traffic, equipment failure, labor shortages, road closures, or force majeure events

In all cases, the Company’s total aggregate liability shall not exceed the amount paid by the customer for the specific delivery service giving rise to the claim.

 

Indemnification

Customer agrees to indemnify, defend, and hold harmless WaterBoy Water and Arden Brody Collab, LLC from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney’s fees) arising out of:

• Inaccurate information provided by the customer
• Unsafe site conditions
• Improper use or storage of delivered water
• Third-party claims related to customer property

Force Majeure

WaterBoy Water shall not be liable for failure or delay in performance due to events beyond reasonable control, including but not limited to:

• Weather events
• Natural disasters
• Government actions
• Fuel shortages
• Equipment breakdown
• Road closures
• Labor disputes

Website Disclaimer

All content on this Site is provided “as is” without warranties of any kind, express or implied.

We do not guarantee:

• Continuous availability
• Accuracy or completeness of information
• That the Site will be error-free or secure

Intellectual Property

All website content, including text, logos, graphics, and layout, is the property of WaterBoy Water and may not be copied or reproduced without written permission.

Governing Law & Venue

These Terms are governed by the laws of the State of Texas.
